{"id":10557,"date":"2026-05-19T09:31:11","date_gmt":"2026-05-19T08:31:11","guid":{"rendered":"https:\/\/mcamps.com\/?p=10557"},"modified":"2026-06-30T12:04:18","modified_gmt":"2026-06-30T11:04:18","slug":"nombres-de-fantasia-medicinales-suplementosalimenticios","status":"publish","type":"post","link":"https:\/\/mcampsco-cp176.wordpresstemporal.com\/eng\/nombres-de-fantasia-medicinales-suplementosalimenticios\/","title":{"rendered":"Medicinal fancy names: AESAN clarifies criteria for their use in food supplements"},"content":{"rendered":"<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Medicinal Fantasy Names <\/strong>- Last March, the Institutional Committee of the <strong>Spanish Agency for Food Safety and Nutrition (AESAN)<\/strong> approved a new <strong>information note<\/strong>, on the <strong>use of medicinal trade names, brand names and fancy names in food supplements. <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those known as \u2018.\u2018<strong>medicinal fantasy names<\/strong>\u2018are those trade names, brand names and fancy names which may be interpreted as alluding to a part of the body or which may suggest a connection with a human disease.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The<strong> medicinal fancy names<\/strong> are a problem, according to AESAN, since they \u00abattribute to the food supplement properties that it does not possess, and may mislead the consumer into believing that a food intended to supplement a normal diet can prevent, treat or cure a human disease\u00bb. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the information note published by the <strong>Spanish Agency for Food Safety and Nutrition (AESAN)<\/strong> on medicinal invented names, a clear distinction is made between 2 typologies of <strong>trade names, trade marks and fancy names<\/strong>; <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>designations that can be interpreted as an allusion to a part of the body<\/li>\n\n\n\n<li>designations that may suggest a link to a human disease<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How should we act, according to the typology of medicinal fantasy names? <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>registered names or trademarks<\/strong> <strong>referring to a part of the body<\/strong>, are considered to be claims of general and non-specific benefits of the nutrient or food for general good health or health-related well-being. In this case they may be used provided they are accompanied by an authorised (or pending) specific health claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of <strong>names or trademarks which may suggest a link to a human disease<\/strong> (cystitis, pain, tension), or even make reference to terms such as treatment, therapy or traditional Ayurvedic medicine, mycotherapy among others, are considered to be <strong>mislead the average consumer, <\/strong>which may interpret the product as having properties intended to prevent, treat or cure diseases. They are therefore in breach of the new food regulations, which <strong>explicitly prohibits any food from<\/strong> -Food supplements are, for regulatory purposes, considered as foodstuffs. <strong>attribute properties of curing\/treating\/preventing a disease or implying it<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>AESAN<\/strong> makes special mention of the <strong>TRADEMARKS<\/strong>, The following are not exempted from complying with the legislation, and therefore must also be supported by a <strong>health claim authorised or pending<\/strong>, if they refer to a part of the body. In addition, they are not allowed if they refer to a disease or imply that they can prevent\/cure\/treat a disease.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link wp-element-button\" href=\"https:\/\/www.aesan.gob.es\/AECOSAN\/docs\/documentos\/seguridad_alimentaria\/interpretaciones\/nutricionales\/nombres_fantasia_CA_2026.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Consult news on medicinal brand names on the AESAN website.<\/a><\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><a href=\"https:\/\/mcamps.com\/wp-content\/uploads\/2026\/05\/Post-petita-MCamps-ampla-23.jpg\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" width=\"900\" height=\"250\" src=\"https:\/\/mcamps.com\/wp-content\/uploads\/2026\/05\/Post-petita-MCamps-ampla-23.jpg\" alt=\"\" class=\"wp-image-10579\" title=\"\" srcset=\"https:\/\/mcamps.com\/wp-content\/uploads\/2026\/05\/Post-petita-MCamps-ampla-23.jpg 900w, https:\/\/mcamps.com\/wp-content\/uploads\/2026\/05\/Post-petita-MCamps-ampla-23-480x133.jpg 480w\" sizes=\"(min-width: 0px) and (max-width: 480px) 480px, (min-width: 481px) 900px, 100vw\" \/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Medicinal fantasy names: the AESAN calendar<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Spanish Agency for Food Safety and Nutrition (AESAN)<\/strong> has established a timetable to allow the industry to adapt its labelling and marketing strategy without compromising the viability of existing stocks:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Entry into force of the criterion<\/strong>18 March 2026<\/li>\n\n\n\n<li><strong>End of placing on the market of new batches<\/strong>1 January 2028<\/li>\n\n\n\n<li><strong>Marketing of stocks<\/strong>Until end of stock (provided the batch is prior to 2028 and within its best-before date).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">As of <strong>1 January 2028<\/strong>, However, no new lots shall be allowed to be placed on the market if they do not comply with these guidelines. However, batches already placed on the market before that date shall be allowed to remain on the market and be marketed until the end of their 'best before' date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can we help you with medicinal fantasy names?
