The European Commission’s Rapid Alert System for Consumers published its Rapex Report dated 2 December 2016 last Friday, in which 47 products were withdrawn from the single market. The sectors most affected by the bans were the automotive and toy sectors, which accounted for approximately 50% of the bans. In this regard, the 10 alerts issued by the Spanish authorities concerned toys, and 100% of these originated from China.
Rapex Report 2 December 2016: two cosmetic products recalled
The Rapex Report has announced the recall of two cosmetic products: firstly, a day cream from Poland, manufactured by Eveline Cosmetics. The other is a rubber duck set containing soap, originating from Belgium and manufactured by Aux Temps des Savons. In the case of the day cream, the recall was due to non-compliance with Regulation (EC) No 1223/2009. Among its ingredients, the cream contained methylisothiazolinone (MI) and methylchloroisothiazolinone (MCI), both of which are banned under European regulations as they cause dermatitis. As for the rubber duck and soap set, the ban was due to the rubber duck, which was made from the plastic di-(2-ethylhexyl) phthalate (DEHP), which can cause reproductive problems in children and is therefore prohibited by the Toy Safety Directive, which regulates the manufacture of toys. We understand that the company classified its product as a cosmetic, and for that reason the European Commission has placed it in that category. However, the soap complied with the Regulation, so we believe it would be more appropriate to classify this product as a toy, given that it was the rubber duck that prompted the recall.
